Terms of service
1 - Purpose
The website www.lusaluso.com (hereinafter referred to as the "Site") is operated by the company Lusa Luso, a Simplified Joint Stock Company (SAS) with a share capital of €10,000.00, registered with the Paris Trade and Companies Register under number 829 842 483, with its registered office at 56 rue Caulaincourt, 75018 Paris.
These general terms and conditions of sale (hereinafter referred to as the "T&Cs") exclusively govern orders placed with Lusa Luso by any individual consumer with the legal capacity to enter into a contract (hereinafter referred to as the "Client") for any product offered on the Site.
The T&Cs may be modified and updated. They are permanently accessible from the Site's homepage. Before making any transaction, the Client acknowledges having read the present general terms and conditions and expressly agrees to them by clicking on the "Place Order" button.
2 – Products
The products offered for sale are those presented on the Site, subject to availability.
Lusa Luso takes the utmost care in presenting and describing its products to provide the best information to its Clients. However, if a product becomes unavailable after an order has been placed, the Client will be informed by email as soon as possible. The total amount paid by the Client for the purchase of this product will be directly refunded to their bank account.
3 – Order
To place an order, the Client must follow the purchase process outlined on the Site.
For a first order, the Client must create a customer account (hereinafter referred to as the "Account") by completing the designated form. This Account is strictly personal to the Client and allows them to log in before confirming each order.
The Client expressly agrees to provide complete and accurate information. In case of an error in the delivery address or incomplete information that makes delivery impossible, Lusa Luso cannot be held responsible.
The Client can only validate their order after reading and accepting the T&Cs by checking the designated box. Consequently, any order placed on the Site constitutes the Client's express and unreserved acceptance of the T&Cs.
Once the Client has validated their order and made the payment, an order confirmation email, including the corresponding invoice, will be sent by Lusa Luso to the email address provided by the Client.
Upon receiving this confirmation email, the Client can track their order by logging into their Account, where their personal information and order history will also be available.
4 – Prices and Payment Terms
Product prices are indicated on the Site in euros (€) and include all taxes (VAT included) as well as any applicable discounts at the time of the order.
The indicated prices do not include delivery charges, which will be billed in addition. Applicable delivery rates will be specified to the Client before the order is confirmed.
Lusa Luso reserves the right to modify its sale prices at any time but agrees to apply the rates in effect on the Site at the time of order confirmation.
The total order price (including all taxes and delivery charges) is the amount indicated in the shopping cart before the order is confirmed. This total amount must be paid in full when the Client validates their order.
Payment is made online using one of the following methods: Carte Bleue, Visa, MasterCard, American Express, Apple Pay, Shop Pay, or PayPal Wallet. Transactions made on the Site use the 3D Secure system.
5 – Delivery
The ordered products are delivered to the address provided by the Client.
Lusa Luso undertakes to make its best efforts to deliver the ordered products within the timeframes indicated during order confirmation. To ensure these timeframes are met, the Client must provide accurate and complete delivery information. Delivery delays beyond our control, such as those related to transport incidents, may occur. Such delays are the responsibility of the carrier. We commit to doing everything possible to resolve delivery issues and provide updated tracking information to the Client.
The Client will be informed by email as soon as possible of any potential delivery delay. In such a situation, the Client will also be notified by email of the new delivery timeframes.
Products sold on the Site can only be delivered to the following countries: Mainland France, the United Kingdom, and European Union countries. Any delivery restrictions are indicated on the Site's product pages.
Deliveries are handled by Colissimo, Mondial Relay, or any other carrier chosen by Lusa Luso from Monday to Saturday (depending on the carriers), based on the option selected by the Client during order confirmation.
Delivery times vary depending on product availability, the delivery location, and the chosen delivery method.
Products ordered on the Site remain the property of Lusa Luso until they are delivered to the address provided by the Client. All risks related to the ordered products (including the risk of loss and/or damage) are transferred to the Client upon delivery.
6 – Exchange and Refund
6.1 – Refund
The Client has a period of 14 (fourteen) calendar days from the receipt of their order to exercise their right of withdrawal and return to Lusa Luso any or all of the ordered products for a refund, without justification or penalty. Sale or discounted items are excluded and may only be eligible for store credit.
If the Client wishes to exercise their right of withdrawal, they must follow the procedure described below:
• The returned products must be in their original packaging and in perfect condition.
• The Client must include in their return package (i) the completed and printed withdrawal form or any other written declaration clearly expressing their desire to withdraw, and (ii) the invoice (accessible from the order confirmation email) or the delivery slip.

Subject to compliance with this procedure, Lusa Luso undertakes to refund the Client the total price of the returned products, including VAT, within a maximum period of 14 (fourteen) days from the date of receipt of the products by Lusa Luso. The refund will be directly credited to the Client's bank account.
Return shipping costs remain the responsibility of the Client.
Partial returns will result in the refund of the returned products only.

6.2 – Exchange or Refund in Store
The Client has a period of 14 (fourteen) calendar days from the receipt of their order to visit the Lusa Luso store, located at 92 Bd Voltaire, Paris 11th (France), to obtain a refund for any or all of the ordered products.
Beyond this period, the Client has an additional 30 (thirty) calendar days from the receipt of their order to visit the Lusa Luso store, located at 92 Bd Voltaire, Paris 11th (France), to exchange the product(s) (subject to stock availability) or receive store credit equivalent to the total value of the returned product(s). This store credit will be valid for a period of 30 (thirty) days.

8 – Data Protection and Privacy
8.1 – Collection and Processing of Personal Data
To meet the needs of its Clients and ensure optimal remote service, Lusa Luso and the Site may collect personal data, such as name, surname, title, email address, date of birth, postal address, delivery address, and phone number.
The personal data collected by the Site and Lusa Luso is processed solely for customer relationship management purposes. Lusa Luso guarantees the confidentiality of the collected personal data.
In accordance with the retention principle of the General Data Protection Regulation (GDPR) and Simplified Standard 48 for the management of customer and prospect files, personal data relating to Clients may not be retained beyond the period strictly necessary for managing the commercial relationship. Lusa Luso undertakes to delete or archive Client data after a period of 3 years following the last purchase.
The Client has the right to access, rectify, and delete their data, as well as the right to erasure or the right to be forgotten and the right to data portability. To exercise these rights, the Client must send an email to the following address: ola@lusaluso.com
8.2 Cookies
The Client, and more generally any user of the Site, acknowledges that by accepting the T&Cs, they authorize Lusa Luso to install cookies on their computer's hard drive to identify each of their connections, allow them to access their Account without re-identifying themselves, and adapt the Site's features to their needs.
Lusa Luso offers Clients and any user of the Site the option to refuse the installation of cookies by modifying their computer's configuration settings. However, such a modification may affect the Site's functionality.
9 - Applicable Law
These general terms and conditions of sale are subject to French law. In case of a dispute, the competent court will be the one in the defendant's place of residence or, at the claimant's choice, the place of effective delivery of the product.
